Terms and Conditions

Promoter: Thrill Flight, 3rd Floor, 86–90 Paul Street, London, EC2A 4NE, United Kingdom (“Promoter”, “we”, “our(s)”, “us”)

Competitions: Any competition resulting in allocation of prizes (“Competition” or “Competitions”), including all associated skill-based questions, conducted via the Thrill Flight website and/or other authorised channels.

1. Qualifying Persons

1.1 Subject to the terms set out herein, each Competition is open exclusively to individuals who have attained the age of 18 years or older at the time of entry and who are residents of the United Kingdom, unless expressly indicated otherwise in the specific Competition Terms. By entering, you confirm that you satisfy these eligibility requirements. Any entry submitted by a person under the age of 18, or who is not a resident of the United Kingdom (unless otherwise permitted), shall be deemed null, void, and ineligible for any Prize.

1.2 Employees, officers, directors, contractors, agents, representatives, or affiliates of the Promoter, or of any company or third party involved directly or indirectly in the design, development, administration, operation, or fulfilment of the Competitions, including but not limited to suppliers, service providers, marketing agencies, or technology providers, and any immediate family members residing in the same household as such persons, are strictly prohibited from entering the Competition. Any Entry submitted in contravention of this clause shall be automatically disqualified, at the Promoter’s sole discretion, without notice or liability.

1.3 By submitting an Entry, each Entrant warrants, represents, and confirms that:
(a) they possess full legal capacity and authority to enter into and be bound by these Terms and Conditions, and, where applicable, to execute any declarations or acknowledgements required for participation;
(b) they are not in breach of any local, national, or international law, statute, regulation, or ordinance in the jurisdiction in which they reside with respect to participating in the Competition;
(c) their participation does not constitute a violation of any contractual or fiduciary obligation to any third party; and
(d) they have obtained all necessary consents, approvals, or permissions required to lawfully enter the Competition if they are participating on behalf of another individual or legal entity.

1.4 The Promoter reserves the absolute right, at its sole discretion, to verify the eligibility of any Entrant, and to disqualify or refuse any Entry that it reasonably believes:
(a) does not comply with these Terms and Conditions;
(b) is fraudulent, misleading, or otherwise in breach of these Terms;
(c) has been submitted using false, inaccurate, or incomplete information;
(d) is intended to circumvent these eligibility requirements, including but not limited to the use of multiple accounts, pseudonyms, or automated systems; or
(e) is in any way abusive, disruptive, or detrimental to the Competition, other Entrants, or the Promoter.

1.5 By entering, you acknowledge and accept that the Promoter may, at its sole and absolute discretion, require the production of documentary or other evidence to verify age, identity, residency, or any other eligibility criteria prior to awarding a Prize. Failure to provide such evidence, or evidence deemed by the Promoter to be unsatisfactory or fraudulent, may result in disqualification, forfeiture of any Prize, and revocation of any rights under these Terms and Conditions.

1.6 Nothing in these Terms and Conditions shall be construed as creating any obligation on the part of the Promoter to permit entry to any individual who does not strictly satisfy these eligibility criteria, and the Promoter reserves all rights to enforce these eligibility requirements rigorously and without prior notice.

2. Legal Undertaking

2.1 By entering any Competition, each Entrant (“Entrant”, “you”, “your(s)”) unequivocally acknowledges, warrants, and agrees that they have read, fully understood, and accepted these Terms and Conditions in their entirety. Entry into a Competition constitutes a legally binding agreement between the Entrant and the Promoter, whereby the Entrant irrevocably agrees to be bound by all provisions, obligations, requirements, and disclaimers contained herein, including, but not limited to, eligibility, Prize acceptance, dispute resolution, liability limitations, and data usage.

2.2 Each Entrant expressly acknowledges that all Competitions shall be governed exclusively by and construed in accordance with the laws of England and Wales. The Entrant hereby submits to the exclusive jurisdiction of the courts of England and Wales, and agrees that any and all disputes, claims, or proceedings arising out of, relating to, or in connection with the Competition, these Terms and Conditions, or any Prize awarded shall be resolved solely in such courts, to the exclusion of any other jurisdiction.

2.3 Each Entrant represents and warrants that their participation in the Competition is lawful in their country of residence, and that they are not in breach of any local, national, or international law by submitting an Entry. The Promoter shall bear no responsibility, liability, or obligation whatsoever for any Entrant who enters a Competition in contravention of any applicable law or regulation. In the event of any doubt regarding the legality of participation, the Entrant must immediately cease entry and consult the relevant governmental, regulatory, or other competent authorities in their jurisdiction prior to proceeding.

2.4 By entering a Competition, each Entrant acknowledges and accepts that:
(a) participation is voluntary and undertaken at the Entrant’s own risk;
(b) the Promoter makes no representations or warranties, express or implied, regarding the legal consequences, appropriateness, or outcomes of participation;
(c) any Entrant found to be ineligible, or who enters unlawfully, or who otherwise breaches these Terms and Conditions, shall be automatically disqualified at the Promoter’s sole discretion without liability or obligation to provide notice, refund, or compensation; and
(d) any legal costs, taxes, or consequences arising from participation, Prize acceptance, or Prize use are the sole responsibility of the Entrant.

2.5 The Entrant further acknowledges and agrees that the Promoter shall not be responsible or liable for any disputes arising between the Entrant and any third party, including but not limited to disputes regarding Prize provision, delivery, or usage, or any actions undertaken by third parties in connection with the Competition.

2.6 The Promoter reserves the right, at its absolute discretion, to amend, vary, or supplement these Terms and Conditions, or impose additional requirements or conditions, at any time, in order to ensure compliance with legal or regulatory obligations, to maintain the integrity of the Competition, or for any other legitimate reason, without prior notice. Continued participation after such amendments shall constitute acceptance of the revised Terms and Conditions.

3. Competition Entry

3.1 Method of Entry
Competitions may be entered either through the designated online platform on the Promoter’s website (“Website”) or, where applicable, via a free postal entry route. The Promoter ensures that a free postal entry mechanism is available for all Competitions, thereby confirming that no Competition falls within the definition of a lottery under the Gambling Act 2005, and that the Competition may be lawfully conducted in the United Kingdom without the requirement for a licence. The availability of a free entry route does not affect the validity or enforceability of paid entries.

3.2 Concurrent Competitions
Multiple Competitions may operate simultaneously. Each Competition shall be treated independently, with its own separate Terms and Conditions, promotion period, Prize, and entry criteria. Participation in one Competition shall not confer any rights, privileges, or obligations in respect of any other Competition, unless expressly stated otherwise in the individual Competition Terms.

3.3 Online Account Registration
To enter a Competition online, an Entrant must first register an account on the Website. Registration requires provision of a valid email address, and may require additional personal information including, but not limited to, full name, date of birth, and contact telephone number. A secure password must be created, and the Entrant is solely responsible for maintaining the confidentiality of their account login details. Entries shall only be deemed valid once successfully submitted and confirmed in the Entrant’s account by the Promoter. The Promoter shall not be liable for any technical errors, failed transmissions, incomplete entries, or other issues arising from the Entrant’s failure to follow online entry procedures correctly.

3.4 Accuracy of Information
All Entrants must provide complete, true, accurate, and up-to-date contact information at the time of entry. Any failure to do so, including incorrect, incomplete, or fraudulent information, may result in automatic disqualification at the Promoter’s sole discretion. The Promoter accepts no liability or responsibility for any consequences arising from the submission of inaccurate or incomplete information, including but not limited to, inability to contact the Entrant, delivery of a Prize, or eligibility verification.

3.5 Postal Entries
Postal entries must be handwritten and include all requested information, including full name, date of birth, email address, contact number, Competition name, and response to any required skill-based question. Postal entries must be sent to the Promoter’s designated address and must arrive by the closing date. Failure to comply with any of these requirements shall result in the Entry being invalid and disqualified. Postal entries are limited to one per Competition per person, and multiple entries submitted on a single postcard or via any other method shall be invalid.

3.6 Entry Limitations and Fraud Prevention
The Promoter reserves the right, at its absolute and sole discretion, to refuse, disqualify, or cancel any Entry that it believes to be:
(a) fraudulent, incomplete, illegible, or otherwise invalid;
(b) submitted in breach of these Terms and Conditions;
(c) the result of automated or third-party software, scripts, or services intended to manipulate the entry process; or
(d) otherwise unfairly advantaged relative to other Entrants.

3.7 Entrant Responsibility
The Entrant acknowledges that they are solely responsible for ensuring that their entry is successfully submitted and recorded. The Promoter shall not be liable for any loss, damage, or consequences arising from technical failures, incorrect information, internet connectivity issues, postal delays, or human error, and shall have no obligation to re-run or extend the Competition as a result of such issues.

3.8 Ownership of Entries
To the fullest extent permitted by law, all Entries, whether online or postal, shall become the property of the Promoter upon submission and shall not be returned. The Promoter reserves the right to use such Entries for audit, verification, marketing, or other lawful purposes related to the Competition.

3.9 Right to Amend Entry Process
The Promoter reserves the right, at its sole discretion and without prior notice, to modify or suspend any aspect of the entry process, including the methods of submission, account registration requirements, or postal entry conditions, in order to ensure fairness, compliance with applicable law, or the proper administration of the Competition.

4. Free Postal Entry

4.1 Postal Entry Requirements
Postal entries must be submitted on a standard postcard, handwritten in ink, and must include all of the following information in a clear and legible manner:

  • The Entrant’s full legal name;

  • Date of birth;

  • A valid email address;

  • Contact telephone number;

  • The name of the specific Competition the Entrant wishes to enter; and

  • The correct response to any skill-based question(s) associated with that Competition.

Any failure to comply with these requirements, including incomplete, illegible, fraudulent, or otherwise inaccurate information, will result in the Entry being deemed invalid and disqualified at the sole discretion of the Promoter. The Promoter shall have no liability for lost, delayed, misdirected, or damaged postal entries, including those lost in transit by the postal service or otherwise.

4.2 Postal Address and Timing
All postal entries must be sent to:
Thrill Flight, 3rd Floor, 86–90 Paul Street, London, EC2A 4NE, United Kingdom.
Postal entries must be received by the Promoter no later than the official closing date of the relevant Competition. The Promoter shall not be responsible for entries that are delivered late, incomplete, or to an incorrect address. First- or second-class postage must be paid by the Entrant. Postage costs, delays, or failures by any postal or courier service remain the sole responsibility of the Entrant.

4.3 Limitations on Entries
Each Entrant is permitted one postal entry per Competition only. Multiple entries for the same Competition must be submitted on separate postcards; entries combined on a single postcard will be deemed invalid and disqualified. Entries submitted in bulk, via automated services, third parties, or by methods other than those expressly permitted herein, shall also be deemed invalid.

4.4 Processing and Allocation
All valid postal entries shall be treated in exactly the same manner as paid or online entries. Each postal entry will be processed by the Promoter or its designated agents and, upon verification of compliance with these Terms and Conditions, will be allocated a unique random number for inclusion in the relevant Competition draw. The Promoter reserves the right, at its sole discretion, to refuse or disqualify any postal entry that is incomplete, illegible, fraudulent, late, or otherwise invalid.

4.5 Entrant Responsibility and Verification
The Entrant is solely responsible for ensuring that their postal entry is successfully submitted and received in accordance with these Terms and Conditions. The Promoter shall have no liability for any postal entry not received, lost, misdirected, damaged, delayed, or otherwise invalid. The Promoter reserves the right to request additional verification or proof of identity and/or age from any Entrant submitting a postal entry before the entry is deemed valid and processed.

4.6 Right to Amend or Suspend Postal Entry Method
The Promoter reserves the right, at its absolute discretion and without prior notice, to amend, suspend, or terminate the postal entry process if deemed necessary to ensure fairness, compliance with applicable law, or the proper administration of the Competition. Such amendments may include, without limitation, changes to submission methods, postal requirements, or processing procedures.

5. Competition Judgement and Winner Selection

5.1 Selection of Winners
The winner(s) of each Competition (“Winner(s)”) shall be selected exclusively using RandomPicker.com, a third-party, independent, fully auditable random draw service platform. Each draw is conducted in accordance with a transparent, publicly verifiable protocol, accessible to Entrants who wish to confirm that their Entry has been included and processed. The Promoter makes no representations or warranties regarding the accuracy, timing, or completeness of the RandomPicker.com service and shall not be liable for any error, omission, or failure in the conduct of the draw, except to the extent required by law.

5.2 Contacting Winners
The Promoter shall make reasonable attempts to contact the Winner(s) using the email address, telephone number, or other contact details provided at the time of Entry (or as subsequently updated by the Entrant). It is the sole responsibility of the Entrant to ensure that all contact information is accurate, complete, and up-to-date. The Promoter shall not be held liable for any consequences arising from incorrect, incomplete, or fraudulent contact information, including but not limited to, failure to receive notification of winning or loss of the Prize.

5.3 Confirmation, Forfeiture, and Disqualification
If the Promoter is unable to contact a Winner within five (5) working days of the draw (this period may be extended at the sole discretion of the Promoter), or if the Winner fails, for any reason, to confirm acceptance of the Prize, the Winner shall be deemed to have forfeited the Prize automatically, irrevocably, and without recourse. In such circumstances, the Promoter reserves the right to retain, reallocate, or otherwise deal with the Prize in any manner it deems appropriate, including but not limited to awarding it to an alternate Entrant, holding it for a future draw, or converting it into a cash equivalent.

5.4 Early Closure, Extensions, and Prize Substitution
The Promoter reserves the absolute discretion to:

  • Close a Competition early for any reason, including but not limited to operational necessity, suspected fraud, technical error, insufficient participation, or legal compliance;

  • Extend the closing date of any Competition at its sole discretion, including multiple extensions, provided that any such extensions shall not be construed as a commitment to further extension;

  • Substitute the Prize, in whole or in part, with an alternative prize of equivalent or greater value, including a cash amount, if the original Prize is unavailable, cannot be delivered, or the Competition is not sold out after all permitted extensions.

Where applicable, any substitute Prize, including cash, may be subject to deductions for marketing, promotional, or administrative costs incurred by the Promoter in connection with the Competition. Such costs may include, without limitation, advertising spend, influencer fees, postage, handling, or operational expenses.

5.5 Fraud, Technical Failures, and Invalid Entries
The Promoter reserves the right to disqualify any Entrant who:

  • Attempts to manipulate, interfere with, or circumvent the Competition process;

  • Submits multiple Entries in contravention of these Terms and Conditions;

  • Provides false, misleading, or fraudulent information; or

  • Otherwise acts in a manner deemed by the Promoter to be unfair, illegal, or in breach of these Terms and Conditions.

In the event of any technical failure, software malfunction, human error, or other event outside the reasonable control of the Promoter affecting the administration of the Competition, the Promoter may take corrective measures, including but not limited to: voiding Entries, re-running the draw, selecting alternate Winners, or modifying the Competition in a manner deemed fair and reasonable. The Promoter shall have no liability for any Entrant affected by such events, and no compensation or damages shall be payable.

5.6 Marketing Consent
Entrants who provide explicit prior consent may have their details, including name, email address, and telephone number, added to the Promoter’s marketing database. This information may be used to convey information regarding the Competition, its outcome, future Competitions, promotions, or other related offers. Entrants may withdraw consent at any time, subject to applicable data protection laws.

5.7 Limitations of Liability
Without prejudice to any mandatory statutory rights, the Promoter shall not be liable for any loss, damage, or inconvenience suffered by an Entrant or Winner arising from or connected with the Competition, including but not limited to:

  • Inability to contact a Winner;

  • Prize substitution or non-availability;

  • Technical or human error in administering the draw;

  • Fraud, unauthorized interference, or Entry manipulation.

The total liability of the Promoter to any Entrant or Winner shall in no circumstances exceed the retail value of the Prize awarded.

6. Prizes

6.1 Acceptance of Prizes
All Prizes are awarded strictly on an “as is” basis and must be accepted in the form in which they are awarded. Winners acknowledge and agree that Prizes are non-transferable, non-exchangeable, and not redeemable for cash, unless expressly permitted by the Promoter at its sole and absolute discretion. The Promoter makes no representations or warranties, express or implied, regarding the quality, fitness for purpose, or merchantability of any Prize, and all such warranties are hereby excluded to the fullest extent permitted by law.

6.2 Delivery and Associated Costs
Delivery of Prizes within the United Kingdom shall be undertaken free of charge to the Winner, unless otherwise specified in the individual Competition Terms. For delivery outside of the United Kingdom, the Winner shall be solely responsible for any and all additional costs, including but not limited to shipping, handling, customs duties, taxes, or import fees, and the Promoter shall have no liability for any delay, loss, or damage arising in connection with international delivery. The Promoter reserves the right to select the courier, delivery method, and timing of delivery at its sole discretion.

6.3 Risk, Insurance, and Liability
All risk in any Prize shall pass to the Winner upon handover or delivery. The Promoter shall have no responsibility for:

  • Theft, loss, damage, or destruction of the Prize after delivery;

  • Any failure of the Prize to operate, function, or perform as intended;

  • Any costs incurred by the Winner in relation to the Prize, including but not limited to maintenance, insurance, or installation.

The Winner is responsible for obtaining any insurance or other protection they deem necessary for the Prize following receipt. The Promoter shall not be liable for any indirect, consequential, or incidental loss, damage, or expense of any nature whatsoever arising from or in connection with the Prize.

6.4 Collection, Storage, and Reallocation
In the event that a Prize is not collected or claimed within thirty (30) calendar days of notification of winning (or such longer period as may be extended at the sole discretion of the Promoter), the Promoter reserves the absolute right to:

  • Store the Prize for an additional period, subject to payment by the Winner of any applicable storage, handling, or administrative fees;

  • Reallocate, substitute, or otherwise dispose of the Prize in its sole discretion;

  • Convert the Prize into a cash or alternative equivalent, including, but not limited to, credit, vouchers, or other prizes, subject to deductions for costs incurred in connection with the Competition, including marketing, administration, or logistics.

6.5 Disqualification and Forfeiture
Any Prize awarded to an Entrant who is subsequently found to have breached these Terms and Conditions, committed fraud, or provided false, misleading, or incomplete information may be forfeited immediately. In such circumstances, the Promoter may, at its sole discretion, reallocate the Prize to another Entrant, retain it, or otherwise dispose of it without liability to the disqualified Entrant.

6.6 General Limitations
Without prejudice to any mandatory statutory rights, the Promoter’s total liability in respect of any Prize shall not exceed the retail value of the Prize as stated in the Competition Terms. The Promoter shall have no liability for any indirect, incidental, or consequential loss arising from the awarding, receipt, or use of a Prize, including but not limited to any loss of opportunity, loss of enjoyment, or reputational loss.

7. Winner Verification

7.1 Verification Requirements
The Promoter reserves the right, at its sole, absolute, and unfettered discretion, to require any Winner to provide evidence satisfactory to the Promoter, in its sole judgment, of the Winner’s identity, age, legal capacity, residency, and full entitlement to receive the Prize (“Verification”). Verification may include, without limitation, government-issued photographic identification (passport, driving licence, national identity card), utility bills, bank statements, or any other documentation or evidence that the Promoter deems necessary or appropriate. The Promoter may also require Verification of email addresses, phone numbers, or other contact information provided at the time of Entry.

7.2 Disqualification and Forfeiture
Any Winner who, in the sole opinion of the Promoter:

  • Is under the age of 18 at the time of Prize award;

  • Fails to provide Verification documents or information as reasonably requested;

  • Has engaged in any fraudulent, deceptive, or improper conduct in relation to the Competition;

  • Has breached or is deemed to have breached these Terms and Conditions in any manner whatsoever; or

  • Is otherwise deemed ineligible for any reason,

shall be automatically and irrevocably disqualified. The Promoter reserves the right, at its sole discretion, to:

  • Retain the Prize;

  • Reallocate the Prize to another eligible Entrant; or

  • Dispose of the Prize in any manner it deems fit.

7.3 Additional Checks and Conditions
Winners acknowledge and agree that the Promoter may undertake any further checks or inquiries as it considers necessary to satisfy itself of the Winner’s eligibility, compliance with these Terms and Conditions, or lawful entitlement to the Prize. Failure, refusal, or inability to provide requested Verification documents or information within the period specified by the Promoter shall result in automatic disqualification, with the Prize immediately forfeited without recourse.

7.4 No Liability
The Promoter shall not be liable for any consequences, losses, or damages arising from the requirement to provide Verification, nor from any disqualification resulting from a failure to comply with Verification requests. The Promoter accepts no responsibility for any Entrant’s inability to provide acceptable documentation or for any delays caused by the Verification process.

8. Limits of Liability

8.1 Personal Injury, Death, and Other Loss
Except to the extent prohibited by applicable law, the Promoter, including its officers, employees, agents, contractors, or any affiliated entities, shall not under any circumstances be liable for:

  • Any death, personal injury, or illness;

  • Any direct, indirect, incidental, consequential, special, punitive, or economic loss or damage of any kind;

  • Loss of profits, revenue, business, data, goodwill, or anticipated savings; or

  • Any other loss, damage, or liability of any nature,

arising from or in connection with:

  • Participation in any Competition;

  • Entry into the Competition, submission of an Entry, or failure to submit an Entry;

  • Collection, possession, use, or misuse of any Prize; or

  • Any act, omission, or negligence of the Promoter, whether foreseeable or unforeseeable.

This includes, without limitation, liability arising from breach of statutory duty, negligence, or any other legal or equitable theory, except where such exclusion is prohibited by law.

8.2 Technical, Operational, and Administrative Failures
The Promoter shall not be responsible or liable, in any circumstances whatsoever, for any failures, faults, or issues arising from or relating to:

  • Any malfunction, failure, unavailability, or interruption of the website, online platforms, digital systems, computer hardware or software, or any electronic communications;

  • Any errors, omissions, lost, delayed, misdirected, corrupted, or incomplete Entries;

  • Any technical failure, cyber-attack, hacking, virus, malware, denial-of-service attack, or other security breach;

  • Malfunction, damage, loss, or non-delivery of any Prize during transport, delivery, collection, or use;

  • Any inability to contact Winners due to incorrect, incomplete, outdated, or otherwise inaccurate contact information; or

  • Any unforeseen circumstances beyond the reasonable control of the Promoter, including but not limited to strikes, industrial disputes, acts of God, natural disasters, fire, flood, acts of terrorism, civil disturbance, or governmental restrictions.

8.3 Maximum Liability
The maximum aggregate liability of the Promoter, whether in contract, tort (including negligence), statutory liability, or otherwise, arising in connection with any Competition or these Terms and Conditions, shall in no circumstances exceed the lower of:

  • The monetary retail value of the Prize as stated in the Competition Terms; or

  • The total amount paid by the Entrant to participate in any Competition operated by the Promoter in the preceding twelve (12) months.

8.4 Entrant Acknowledgements
By participating in the Competition, each Entrant expressly acknowledges and agrees that:

  • Participation is undertaken entirely at their own risk;

  • They are solely responsible for any personal safety, health, or legal compliance matters;

  • They release and indemnify the Promoter from all claims, costs, damages, or liabilities arising from participation or Prize acceptance, except to the extent prohibited by law; and

  • Nothing in these Terms and Conditions shall limit or exclude liability that cannot legally be limited or excluded, including statutory consumer rights.

9. Data Protection

9.1 Use of Personal Data
By entering a Competition, each Entrant expressly acknowledges, agrees, and consents that the Promoter may collect, process, store, and use their personal data, including but not limited to name, date of birth, email address, phone number, postal address, and any other information provided in connection with the Competition (“Personal Data”), solely for the purposes of:

  • Administering, managing, and operating the Competition, including but not limited to verifying eligibility, processing Entries, selecting Winners, awarding Prizes, and notifying Winners;

  • Conducting any Verification or due diligence procedures in accordance with these Terms and Conditions;

  • Fulfilling any legal or regulatory obligations imposed on the Promoter in connection with the Competition; and

  • Sending marketing communications, promotional material, or future Competition invitations only where the Entrant has provided explicit consent to receive such communications, which consent may be withdrawn at any time in accordance with applicable data protection law.

Entrants further acknowledge and agree that failure to provide accurate, complete, and up-to-date Personal Data may result in disqualification or forfeiture of a Prize, and the Promoter shall not be liable for any consequences arising from inaccurate or incomplete data submitted by the Entrant.

9.2 Third-Party Processors and International Transfers
Personal Data may be processed, stored, or transferred by the Promoter or its authorised third-party service providers, contractors, or agents, including but not limited to cloud storage providers, marketing platforms, IT service providers, and logistics partners.

Such processing or transfer may occur within or outside the United Kingdom. Any international transfers shall only take place in compliance with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and any other applicable data protection legislation, and shall ensure that adequate technical, organisational, and contractual measures are implemented to maintain the security, confidentiality, and integrity of Entrants’ Personal Data.

10. Accounts and Passwords

10.1 Account Responsibility and Security
Each Entrant acknowledges and agrees that they are solely responsible for:

  • Maintaining the confidentiality, security, and integrity of any account credentials, including but not limited to usernames, email addresses, passwords, PINs, security questions, or any other identifiers used to access or participate in the Competition (“Account Credentials”);

  • Any and all activities, transactions, or Entries conducted via their account, whether authorised or unauthorised; and

  • Ensuring that all Account Credentials are created, stored, and used in a secure manner that prevents unauthorised access by third parties.

Entrants further acknowledge that failure to protect Account Credentials may result in disqualification from the Competition, loss of Entries, forfeiture of Prizes, or other adverse consequences, and the Promoter shall not be held responsible or liable for any such outcomes.

10.2 Notification of Breach or Misuse
Entrants must immediately notify the Promoter if they become aware of, suspect, or reasonably believe that:

  • Their Account Credentials have been compromised, stolen, lost, or otherwise accessed by unauthorised persons;

  • Any unauthorised or fraudulent activity has occurred in connection with their account; or

  • There has been any breach, error, or malfunction affecting account security.

  • Loss of, or inability to access, Entries or account data due to technical failures, security breaches, or errors beyond the Promoter’s reasonable control;

  • Any other matter related to the administration, operation, or security of Entrants’ accounts.

Entrants acknowledge and agree that the Promoter exercises reasonable care to safeguard account security, but cannot guarantee absolute protection against unauthorised access, and the Promoter’s liability for any account-related loss is hereby strictly limited.

10.4 Obligation to Cooperate
Entrants agree to fully cooperate with the Promoter in any investigation relating to account misuse, suspected fraud, or breaches of these Terms and Conditions. This may include, at the Promoter’s discretion, providing further information, evidence, or documentation to substantiate claims of account ownership or activity. Failure to cooperate may result in immediate disqualification and forfeiture of any Prize awarded.

11. Use of Website

11.1 Permitted Use
The Competition website, including all associated content, software, applications, services, and functionality (collectively, the “Website”), is provided solely for the personal, non-commercial use of Entrants in connection with participation in the Competitions. Entrants expressly agree that they shall not, under any circumstances, use the Website for:

  • Any unlawful, fraudulent, deceptive, or prohibited purpose;

  • Any purpose that violates applicable local, national, or international laws or regulations; or

Entrants acknowledge that the Promoter retains the right, at its sole discretion, to restrict, suspend, or terminate access to the Website for any Entrant found in breach of this Clause 11.1.

11.2 Prohibited Conduct
Entrants shall not, and shall not attempt to, directly or indirectly:

  • Introduce, transmit, or otherwise distribute any viruses, malware, worms, trojans, spyware, adware, or other harmful, disruptive, or malicious code;

  • Flood, spam, overload, or impair the Website, servers, databases, or networks associated with the Competition;

  • Engage in hacking, phishing, data mining, scraping, or any automated or manual activity that interferes with the proper functioning, security, or integrity of the Website or Competitions;

  • Circumvent, bypass, disable, manipulate, or otherwise interfere with any security, authentication, or access controls of the Website;

  • Attempt to gain unauthorised access to any account, server, system, database, or data connected with the Competition; or

  • Take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Website or otherwise compromises its operation or integrity.

The Promoter reserves the right, at its sole and absolute discretion, to report any unlawful activity to law enforcement authorities and to take legal action to the fullest extent permitted by law.

11.3 Indemnity

  • The Entrant’s use, misuse, or attempted misuse of the Website;

  • Any breach or alleged breach by the Entrant of these Terms and Conditions;

  • Any prohibited, unlawful, fraudulent, or negligent conduct by the Entrant in connection with the Website or Competitions; or

  • Any damage to or loss of data, systems, software, or other property resulting from the Entrant’s acts or omissions in connection with the Website.

Entrants acknowledge and agree that this indemnity obligation survives the termination of their access to the Website or participation in any Competition, and that the Promoter may, at its sole discretion, take any legal or equitable action necessary to enforce this indemnity.


12. Changes and Discretion

12.1 Amendments and Variations
The Promoter reserves the unrestricted, absolute, and sole right, at any time and without prior notice, to amend, vary, modify, or supplement:

  • The rules, eligibility criteria, skill-based questions, methods of entry, or other procedural requirements for any individual Competition;

Entrants acknowledge and agree that continued participation in any Competition after such amendments constitutes acceptance of the amended terms.

12.2 Finality of Promoter Discretion
The Promoter shall have sole and unfettered discretion in relation to all matters concerning the Competitions, including but not limited to:

  • The determination of whether any Entry is valid, eligible, complete, or compliant with these Terms and Conditions;

  • The interpretation of any provision of these Terms and Conditions or individual Competition rules;

  • The allocation, awarding, or forfeiture of any Prize;

All such discretionary decisions by the Promoter are final, conclusive, binding, and non-contestable, and Entrants hereby waive any right to dispute or challenge such decisions in any forum, whether administrative, judicial, or otherwise, to the fullest extent permitted by law.

12.3 Competition Flexibility and Prize Substitution
Without limitation, the Promoter may, at its sole and absolute discretion:

  • Extend the closing date, time, or duration of any Competition, with such extension to be for any period and number of times as the Promoter deems appropriate;

  • Close any Competition prior to the originally advertised closing date, for reasons including but not limited to operational necessity, technical failure, insufficient participation, fraud, or force majeure;

  • Substitute, alter, or modify any Prize, in whole or in part, with an alternative Prize of equivalent or greater monetary or retail value, subject to any deductions for marketing, administrative, or operational costs reasonably incurred by the Promoter in the promotion or management of the Competition;

  • Reallocate, retain, or otherwise manage Prizes in circumstances where Winners cannot be contacted, fail to comply with Verification requirements, are disqualified, or where a Prize cannot be awarded for any reason outside the reasonable control of the Promoter.

Entrants expressly acknowledge that no claim shall arise against the Promoter for any amendment, variation, extension, closure, or substitution exercised under this Section 12, and that the Promoter shall not be liable for any loss, disappointment, or damage (direct or indirect) suffered as a result of such exercise of discretion, to the fullest extent permitted by law.

13. General

13.1 Entire Agreement and Supersession

13.3 Force Majeure and Events Outside Reasonable Control
The Promoter shall not, under any circumstances, be held liable, responsible, or accountable for any loss, damage, disappointment, or other adverse consequence arising directly or indirectly from any event, circumstance, or condition outside its reasonable control. Such events include, without limitation:

  • Acts of God, including lightning, flood, earthquake, fire, storm, or other natural disasters;

  • Industrial action, strikes, lockouts, or labour disputes of any kind;

  • Pandemics, epidemics, outbreaks of infectious disease, or quarantine restrictions;

  • Acts of war, terrorism, civil disturbance, riot, or insurrection;

  • Acts, omissions, or instructions of governmental authorities or regulators;

  • Failure, malfunction, or unavailability of any telecommunications, digital, or internet networks or systems;

  • Technical failures affecting the website, entry processing, Prize allocation, or communication with Entrants; or

  • Any other circumstance beyond the reasonable control of the Promoter.

In such cases, the Promoter may, at its sole and absolute discretion, modify, suspend, cancel, or reschedule the Competition or Prize without liability to Entrants, and Entrants expressly waive any claim or right to compensation, damages, or reimbursement.
